SECTION 1 — ACCESS AND ACCOUNT

You may use the Services to browse or purchase products. If you are under 18, you must have permission from a parent or legal guardian, who must also be the owner of the payment method used.

You may be required to provide information including your name, email address, billing address, shipping address, and payment details. You represent that all information provided is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials. You may not assign or transfer your account to another person.

SECTION 2 — OUR PRODUCTS (PRINT-ON-DEMAND)

Highpath Apparel operates on a print-on-demand (POD) basis. This means:

  • All items are made to order.

  • Colour appearance, print placement, and scale may vary slightly due to device display differences and POD production processes.

  • These minor variations do not constitute defects.

We may change or discontinue products at any time without notice. We may also limit sales to specific regions or individuals.

SECTION 3 — ORDERS

Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason. An order is considered accepted only when we confirm it by email.

Because POD items enter production quickly, cancellations may not be possible after the order has been accepted.

All purchases are subject to our Refund Policy.

Products are sold for personal use only—not for commercial resale.

SECTION 4 — PRICES & BILLING

Prices are displayed in GBP (£) unless stated otherwise. Prices may vary for international markets depending on currency and Shopify Markets settings.

Prices exclude:

  • shipping

  • handling

  • customs or import fees (if applicable)

We may modify pricing at any time without notice.

You agree to provide accurate and current billing details. You confirm that you are authorised to use the payment method provided.

SECTION 5 — SHIPPING & DELIVERY

Shipping times shown on the website or at checkout are estimates only and may vary depending on production speed, fulfilment centre workload, customs delays, or courier issues.

Once an order is passed to the carrier, title and risk transfer to you.

For international shipments, customs or import fees may apply and are your responsibility.

SECTION 6 — INTELLECTUAL PROPERTY

All trademarks, logos, product designs, text, graphics, images and content are owned by Highpath Apparel (or our licensors) and protected by UK and international intellectual property laws.

You may only use the Services for personal, non-commercial purposes. You may not copy, redistribute, modify, publish, or create derivative works without our written permission.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools or services (including fulfilment partners such as Gelato). These are provided “as is” without warranties. Your use of third-party tools is at your own risk.

We may introduce new tools or features in the future; these are also subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

Our Services may include links to third-party websites. We are not responsible for their content or practices. You access them at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

The Services are hosted by Shopify. While Shopify provides the e-commerce platform, all sales and customer interactions occur directly between you and Highpath Apparel.

You acknowledge that Shopify is not responsible for your purchases and releases Shopify from all related claims or liabilities.

SECTION 10 — PRIVACY POLICY

Your use of the Services is subject to our Privacy Policy. Because the platform is hosted by Shopify, certain personal information is shared with Shopify to enable the Services.

By using the Services, you consent to this processing of your information.

SECTION 11 — FEEDBACK

If you submit feedback, suggestions, reviews or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce and publish such content.

You warrant that you own or control the rights to any Feedback submitted and that it does not infringe any third-party rights.

SECTION 12 — ERRORS & OMISSIONS

The Services may contain errors relating to product descriptions, pricing, availability or promotions. We reserve the right to correct such errors at any time without notice.

SECTION 13 — PROHIBITED USES

You agree not to use the Services:

  • for unlawful purposes

  • to violate intellectual property rights

  • to harass, abuse or harm others

  • to upload malware or malicious code

  • to engage in fraudulent or misleading conduct

  • to interfere with security features

  • to spam or scrape data

We may suspend your access to the Services if we believe you have violated these Terms.

SECTION 14 — TERMINATION

We may terminate your access to the Services at any time for any reason. You remain responsible for all charges incurred up to the time of termination.

SECTION 15 — DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available” without warranties of any kind, except where required by UK law.

We do not warrant that the Services will be error-free, uninterrupted, or secure.

Nothing in this section affects your statutory rights as a UK consumer.

SECTION 16 — LIMITATION OF LIABILITY

To the fullest extent permitted by UK law:

  • We are not liable for indirect or consequential losses

  • We are not liable for courier delays, fulfilment issues, or third-party service failures

  • Our total liability for any claim is limited to the amount you paid for the item in question

Nothing in these Terms excludes liability for fraud, or death/personal injury caused by negligence.

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless Highpath Apparel from claims arising out of your misuse of the Services or breach of these Terms.

SECTION 18 — SEVERABILITY

If any part of these Terms is found unlawful or unenforceable, the remaining provisions will remain in force.

SECTION 19 — WAIVER & ENTIRE AGREEMENT

These Terms, together with our policies, constitute the entire agreement between you and us.

SECTION 20 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms.
We may assign our rights at any time without notice.

SECTION 21 — GOVERNING LAW

These Terms and all purchases made through the Services are governed by the laws of England and Wales.

Any disputes shall be handled exclusively by the courts of England and Wales.

SECTION 22 — CHANGES TO THESE TERMS

We may update these Terms at any time. It is your responsibility to review this page regularly. Your continued use of the Services constitutes acceptance of any changes.
